Client Agreement: Audit Check + Dispute Pack

Effective October 21, 2026

This Client Agreement (the "Agreement") is between TrueUpAudit ("we," "us") and the business that places an order ("you"). You accept it by checking the agreement box and completing checkout. Keep a copy; you can print or save this page at any time.

1. What we do

For each order we (a) review the documents you provide about one workers' compensation premium audit for one policy period, (b) recalculate the audited premium using published rating rules and the rates and factors on your own policy, (c) give you a written findings report listing each possible error we identify, with the rule we relied on, the evidence, an estimate of the dollars at stake, and a confidence label, and (d) prepare draft letters for you to review, sign, and send yourself, such as a worksheet request, a line-item dispute letter, and, where it applies, a packet for the NCCI dispute resolution process.

2. What we don't do

3. Eligibility

We accept orders only for policies issued in the states listed on our order page. If we learn that your policy was issued in another state, we will refund your fee in full and won't perform the services. One order covers one policy and one policy period; policies with more than three states may need a separate quote.

4. Your responsibilities

5. Fees and payment

The fee is a flat $249 when less than $10,000 is at stake and $449 when $10,000 or more is at stake, based on the amount you enter when ordering. If your documents show the amount at stake is materially higher than you entered, we'll tell you before starting and you may pay the difference or cancel for a full refund. Payment is collected at checkout by Stripe. Fees don't depend on the outcome of your dispute.

6. Findings refund

If your findings report doesn't contain high-confidence findings whose combined estimated dollars at stake are at least two times the fee you paid, we will refund the full fee. "High-confidence" means the finding rests on a published rule and on figures shown in your documents, without depending on facts we couldn't verify. If you never send the required documents, or ask for a refund before we start work, we refund the full fee. A refund is the only remedy under this section and doesn't depend on what your carrier decides.

7. Delivery

We aim to deliver your report and letter pack within 3 business days after we receive the documents we need. We'll tell you promptly if something is missing. Delivery is by email to the address on your order.

8. No guarantee of outcome

Carriers, rating bureaus, and state agencies apply their own rules and judgment. We don't promise that your carrier will accept any finding, reduce your bill, or issue a refund. Dollar figures in our report are estimates.

9. Confidentiality and your files

We use your documents only to perform the services and to answer your questions about them. We don't sell them or share them except with service providers who help us operate (such as hosting, email, and payment processing) or when the law requires it. We keep order files for 3 years and then delete them; email us to delete them sooner. See our Privacy Policy.

10. Limitation of liability

To the fullest extent the law allows: (a) our total liability for any claim arising out of or relating to an order or this Agreement is limited to the fee you paid for that order; and (b) we are not liable for indirect, incidental, special, or consequential damages, or for any premium, penalty, interest, or other amount you pay, owe, or fail to recover. Some of these limits may not apply where the law doesn't allow them.

11. Disputes with us

If you have a problem with our work, email hello@trueupaudit.com first, and we'll try to resolve it within 30 days. If we can't, either of us may bring an individual claim in small claims court in Dallas County, Texas, or have the dispute resolved by binding individual arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, held in Dallas County, Texas, or by video. Claims may be brought only individually, not as part of a class or representative action.

12. Governing law

This Agreement is governed by the laws of the State of Texas, without regard to its conflict-of-law rules, and by the Federal Arbitration Act for Section 11.

13. Other terms

This Agreement, together with our Terms of Use and Privacy Policy, is the whole agreement for your order; if they conflict, this Agreement controls. We may update this Agreement for future orders; the version in effect when you ordered applies to your order. If any part is unenforceable, the rest stays in effect.
